### 1. Acceptance and eligibility
These Terms govern Nuvaret.com and purchases from Nuvaret. By using the site or placing an order, you agree to them and represent that you are legally able to enter a binding agreement in your location and that information you provide is accurate. If you do not agree, do not use the site or place an order.
### 2. Orders and store operations
Nuvaret may change, limit, suspend, or discontinue products, content, prices, promotions, destinations, and site features at any time. A submitted order is an offer to purchase; it is accepted only when we confirm acceptance or dispatch, as permitted by law. We may refuse, limit, cancel, or refund an order before dispatch for a pricing, inventory, product-description, payment, address, fraud, sanctions, export-control, legal, or fulfilment issue. We may request additional verification before fulfilling an order.
### 3. Prices, tax, payment, and chargebacks
Prices and currency are displayed at checkout. We may correct an obvious pricing or technical error before dispatch. Customers are responsible for applicable tax, import duty, customs, brokerage, and local charges unless checkout expressly states otherwise. Do not initiate an improper chargeback; contact support@nuvaret.com first so we can investigate. We may provide order, delivery, support, and fraud-prevention records to processors or authorities to defend a dispute. This does not restrict any cardholder right that cannot lawfully be restricted.
### 4. Made-to-order products and delivery
Products are made or prepared after acceptance. Production, shipping, carrier transit, customs processing, and delivery estimates are estimates—not guarantees—unless law requires otherwise. We may use multiple fulfilment partners and carriers, so items may arrive separately. We are not responsible for loss, delay, or added cost caused by an inaccurate address, failed delivery attempt, refusal, customs delay, carrier disruption, force majeure, or events beyond reasonable control.
Nuvaret’s intended primary markets are Canada and the United States. The checkout destinations are the only destinations actually served. Mexico and other international destinations are deferred until Nuvaret has enabled them at checkout and confirmed fulfilment, delivery, tax, privacy, and support readiness. The customer is the importer of record where applicable and is responsible for customs declarations and charges unless checkout says otherwise.
### 5. Final-sale policy and claims
Except for a confirmed defect, misprint, damage, incorrect item, or a remedy required by law, made-to-order items are final sale. We do not accept change-of-mind, colour-preference, incorrect-size, or customer-address returns. For a damaged, misprinted, or incorrect item, email support@nuvaret.com within 14 days of delivery with the order number, a description, and clear photos. We may request further evidence and return/destruction instructions. If approved, Nuvaret may select the legally available remedy: replacement, repair, store credit, or refund. Unapproved returns are not accepted or reimbursed.
### 6. Product information, fit, and care
We aim for accuracy, but screen settings, production methods, and made-to-order processes can create reasonable variation in colour, placement, texture, measurements, packaging, and finish. Mockups, photographs, descriptions, and delivery estimates are illustrative unless expressly stated otherwise. Customers must review size, product, and care information before purchasing. We do not guarantee that a product will meet a subjective preference or be identical to a screen image.
### 7. Acceptable use and intellectual property
Use the site only for lawful personal shopping. Do not interfere with it; bypass security; use bots, scraping, data mining, or automated orders without written permission; submit false information; commit payment fraud; resell products as authorized Nuvaret merchandise; or infringe rights. Nuvaret and its licensors own the brand, designs, site, text, graphics, photographs, and related intellectual-property rights. No licence is granted beyond a limited personal right to shop. You may not copy, reproduce, adapt, distribute, display, sell, or create derivative works without written permission.
### 8. Disclaimers and liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” NUVARET DISCLAIMS WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUVARET AND ITS OWNERS, PERSONNEL, SUPPLIERS, AND SERVICE PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. If liability cannot be excluded, Nuvaret’s total liability for a claim will not exceed the amount paid to Nuvaret for the product or order giving rise to the claim, except where greater relief is required by law.
### 9. Indemnity
To the maximum extent permitted by law, you will indemnify Nuvaret and its owners, personnel, suppliers, and service providers from claims, losses, liabilities, costs, and reasonable legal fees arising from your unlawful site use, breach of these Terms, fraud, or infringement of another person’s rights.
### 10. Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in British Columbia have exclusive jurisdiction, except where a consumer’s mandatory local law allows another forum or prohibits this provision. Before formal proceedings, contact support@nuvaret.com with enough detail to investigate and allow 30 days for informal resolution. This does not prevent urgent injunctive relief for intellectual-property, security, fraud, or misuse matters.
### 11. General and contact
If a provision is unenforceable, it will be enforced to the maximum lawful extent and the rest remains effective. Nuvaret’s failure to enforce a provision is not a waiver. Nuvaret may assign these Terms in connection with a restructuring, financing, or sale. These Terms and incorporated policies are the entire agreement for site use and purchases.
